How Lien Status Is Achieved

The means of achieving lien status and the length of time the lien is in effect vary from state to state. In New York, for example, a judgment becomes a lien on the debtor's property once it is docketed by the clerk of the court of the county in which the debtor's real property is situated from the time of the filing of a notice of levy pursuant to an execution. The lien then becomes effective for ten years. In contrast, in Tennessee certain judgments become liens once a certified copy of the judgment is registered in the county in which the debtor's real property is located and the lien is effective for only one year.
