Cash Crisis in the Automotive Supply Sector

According to a recent industry report, problems in the automotive-supply sector could unhinge the supply chain for car manufacturers and even cause a halt in vehicle production. The claim comes from a survey of top automotive suppliers in North America , which found that more than a fifth of them could face significant financial problems over the next twelve months. About a third of North America's automotive suppliers are under financial distress, according to one business consulting company. Other problems facing automotive-supply companies, and in turn automobile makers themselves, are high raw-materials costs, expenses for healthcare and labor and legacy costs for retirees, all of which could possibly push some automotive suppliers into bankruptcy proceedings.

Question: Explain the relationship between bankruptcy dismissals and the failure to provide payment advices.

Answer: Where bankrupt firms previously often filed payment advices late and judges were not as concerned that the advices were filed within the 45 days necessary, increasingly, the U.S. Bankruptcy Courts are forcing debtors, and their attorneys, to adhere to section 521(I)(2) of the U.S. Bankruptcy Code as it relates to payment advices. In one case, a debtor's attorney, claimed he had delivered payment advices to the U.S. trustee as well as a Chapter 7 trustee. However, he was experiencing computer problems and was not able to make the filings to the 341 creditors' meeting within the 45-day period. Nevertheless, the court held that the statute was clear. On the 46th day, cases were automatically dismissed if payment advices or a motion to extend time had not been filed.
