No-Asset Chapter 7 Bankruptcy Filings
In a no-asset Chapter 7 filing, there are no nonexempt assets and most unsecured debt will be discharged. Therefore, the only creditors that will participate in the case are the ones who hold security. Those creditors can file motions for relief from the automatic stay in order to foreclose on loans or repossess property securing those loans. The U.S. Bankruptcy Court generally holds a hearing on such a motion at which creditors can contest the proposed action.
