Educational Tidbits For Today's Credit Executive
No-Asset Chapter 7 Bankruptcy Filings

In a no-asset Chapter 7 filing, there are no nonexempt assets and most unsecured debt will be discharged. Therefore, the only creditors that will participate in the case are the ones who hold security. Those creditors can file motions for relief from the automatic stay in order to foreclose on loans or repossess property securing those loans. The U.S. Bankruptcy Court generally holds a hearing on such a motion at which creditors can contest the proposed action.

The Credit Manager's Q&A Corner

QUESTION: Describe a preference as it relates to payments in a bankruptcy filing.

ANSWER: A preference is a payment by a debtor made during a specified period, such as ninety days to one year, prior to the filing that favors one creditor over others. Usually, preference payments can be recovered and returned to the debtor's estate.
